Why does my Diablo II character die and then appear again in the same spot where the death occurred?
If a character gains some life at the point of death, then the character will be "resurrected" on top of the corpse instead of in town. We are aware of this issue, and we are looking into a solution at this time. When we find a solution, we will include it in a future update to the game.
For now we suggest you press the ESC key as soon as your character dies. If this does not help, you will have to save and exit the game and then start a new game with the same character.
