Disclaimer. Sponsor, all participating sponsors and any of their respective parent companies, subsidiaries, affiliates, directors, officers, professional advisors, employees and agencies will not be responsible for: (a) any late, lost, misrouted, garbled or distorted or damaged transmissions or entries; (b) telephone, electronic, hardware, software, network, Internet, or other computer- or communications-related malfunctions or failures; (c) any Contest disruptions, injuries, losses or damages caused by events beyond the control of Sponsor; or (d) any printing or typographical errors in any materials associated with the Contest.
Contest Period: The Contest shall commence upon 12:01 p.m., Pacific Standard Time on August 26, 2011, and entries will be taken until 11:59 p.m., PST October 10, 2011, or until one hundred (100) entrants have registered for the Contest, whichever occurs first (the “Deadline”).
a. Primary Winners. The top three winners of the Contest (“Primary Winners”) will be chosen by Sponsor from all qualified entrants, and announced at BlizzCon, where they will receive the following prizes: 1. First Place Winner. One (1) qualified entrant will be chosen by Sponsor as the “First Place Winner,” and will receive a check or pre-paid card (such as a pre-paid VISA card or pre-paid American Express Card, as determined by Sponsor in its sole discretion), in the amount of Three Thousand Dollars ($3,000.00 USD) at BlizzCon.
2. Second Place Winner. One (1) qualified entrant will be chosen by Sponsor as the “Second Place Winner,” to receive a check or pre-paid credit card or pre-paid card (such as a pre-paid VISA card or pre-paid American Express Card, as determined by Sponsor in its sole discretion), in the amount of Two Thousand Dollars ($2,000.00 USD) at BlizzCon.
3. Third Place Winner. One (1) qualified entrant will be chosen by Sponsor as the “Third Place Winner,” and will receive a check or pre-paid card (such as a pre-paid VISA card or pre-paid American Express Card, as determined by Sponsor in its sole discretion), in the amount of One Thousand Dollars ($1,000.00 USD) at BlizzCon.
b. Secondary Contestants. Additionally, Sponsor shall also designate twenty (20) additional qualified entrants as Secondary Contestants. The Secondary Contestants will have their photographs taken in their costumes at BlizzCon by Sponsor, which will then post the photographs on Sponsor’s BlizzCon website by October 28, 2011, where visitors may vote on which of the Secondary Contestant’s costumes until November 18, 2011 (the “Voting Period”). Based on the number of votes received during the Voting Period, Sponsor shall award the following prizes to ten (10) Secondary Contestants, based on the following:
1. The Secondary Contestant who receives the highest number of votes on the BlizzCon Website during the Voting Period will receive a check or pre-paid card (such as a pre-paid VISA card or pre-paid American Express Card, as determined by Sponsor in its sole discretion), in the amount of One Thousand Dollars ($1,000.00 USD).
2. The Secondary Contestant who receives the second highest number of votes on the BlizzCon Website during the Voting Period will receive a check or pre-paid card (such as a pre-paid VISA card or pre-paid American Express Card, as determined by Sponsor in its sole discretion), in the amount of Seven Hundred Fifty Dollars ($750.00 USD).
3. The Secondary Contestant who receives the third highest number of votes on the BlizzCon Website during the Voting Period will receive a check or pre-paid card (such as a pre-paid VISA card or pre-paid American Express Card, as determined by Sponsor in its sole discretion), in the amount of Five Hundred Dollars ($500.00 USD).
4. The Secondary Contestants who receives the fourth, fifth, and sixth highest number of votes on the BlizzCon Website during the Voting Period will each receive a prize package consisting of one (1) SteelSeries 5H V2 Headphones, one (1) SteelSeries 7G Keyboard, and one (1) SteelSeries Ikari Optical Mouse, with a combined approximate retail value of $290.00.
5. The Secondary Contestants who receives the seventh, eighth, ninth and tenth highest number of votes on the BlizzCon Website during the Voting Period will each receive a World of Warcraft® virtual pet prize package consisting of one (1) Lil' Ragnaros, one (1) Moonkin Hatchling, one (1) Lil' K.T., one (1) Pandaren Monk, and one (1) Lil' XT, with a combined approximate retail value of $50.00.
ALL FEDERAL, STATE AND LOCAL TAXES ASSOCIATED WITH THE RECEIPT OR USE OF ANY PRIZES ARE THE SOLE RESPONSIBILITY OF THE WINNER.
All prizes will be awarded. Prize Winners must execute an affidavit of eligibility before they can receive their Prize. Prizes returned as undeliverable or otherwise not claimed within fifteen (15) days after delivery of notification will be forfeited and awarded to an alternate winner. Prizes are not transferable. No substitutions or exchanges (including for cash) of any prizes will be permitted, except that Sponsor reserves the right to substitute a prize of equal or greater value for any prize. Limit one prize per household or address. All prizes are awarded "AS IS" and WITHOUT WARRANTY OF ANY KIND, express or implied, (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose).
How to Enter: Beginning on August 26, 2011, you may sign up to enter the Contest online at www.BlizzCon.com. The Contest is limited to a maximum of one hundred (100) qualified Entrants will be accepted for the Contest. Entrants who register online are required to ‘check in’ at the information booth no later than 2:00 p.m., on October 21, 2011 to confirm that they are in attendance at the Event. In the event that maximum number of qualified entrants has not been reached by the beginning of BlizzCon, Sponsor will allow BlizzCon attendees who otherwise meet the eligibility requirements for the Contest to sign up on site on a ‘first come, first served,’ basis. Note that in order to be eligible for the Contest, costumes:
(i) Must be not be wider than 10 feet across, longer than 10 feet, nor taller than 10 feet;
(ii) cannot include, or otherwise utilize, any edged weapons (such as knives, daggers, swords), firearms of any kind including air guns, long bows, crossbows, or any other type of projectile weapon regardless of whether it is unloaded or nonfunctional; ‘actual’ clubs, maces, or other ‘crushing weapons.’ Acceptable costume ‘weapon props’ will be limited to air filled or soft plastic swords, daggers, maces or clubs, and wooden staves that are not shod with metal;
(iii) may not include liquids, gels, or other substances which could cause a mess in Sponsor’s sole discretion;
(iv) should not be the same character or costume that a qualified entrant used to enter previous BlizzCon Costume contests.
Contest Rules.. At the commencement of the Contest, which shall be at approximately 6:30 p.m. on October 21, 2011, each qualified Entrant shall demonstrate their costume which should be based upon the Sponsor’s game franchises, “Diablo,” “StarCraft, and “Warcraft.” Note that costumes will only be judged on what is “worn,” and props that are held by qualified entrants. While Sponsor may, in its sole discretion, attempt to accommodate non held or worn costume props for display on stage, such props will not be considered by the judges when judging the entries. Sponsor shall choose the winners based on the originality, design and presentation of the qualified Entrants. Winners shall be chosen by Sponsor at its sole discretion, with the winners announced immediately following the Costume presentations at the Contest. The decision of Sponsor is final. To claim a prize, winners should follow the instructions provided to them by Sponsor.
Sponsor Use of Entries. You hereby agree that in consideration of your being allowed the chance to enter the Contest, Sponsor shall have the perpetual, non-exclusive, worldwide license and right to utilize your name, character, likeness, and a biography of you. Sponsor shall have the right to use, modify, reproduce, publish, perform, display, distribute, make derivative works of and otherwise commercially and non-commercially exploit your name, character, likeness, and a biography of you in perpetuity and throughout the universe, in any manner or medium now existing or hereafter developed, without separate compensation to you or any other person or entity. You agree to take, at Sponsor's expense, any further action (including, without limitation, execution of affidavits and other documents) reasonably requested by Sponsor to effect, perfect or confirm Sponsor's rights as set forth above in this paragraph 7.
Collection of Information. The Entry Materials include a survey that requires you to enter your name, e-mail address, and state of residence. By entering the Contest, you consent to Sponsor's use of this information to inform you of open positions with Sponsor, and to associate your name with your submission in promotional materials for the Contest in the event that you are chosen to be a winner. As stated above, the contest is not open to anyone under the age of majority in your country of citizenship. In the event that Sponsor becomes aware that you are under the age of majority in your country of citizenship Sponsor will delete, erase or destroy any and all personally identifiable information that is obtained from the Entry Materials. In the event that you are a citizen of France and/or any of the other countries whose citizens are eligible for this Contest, and pursuant to French law pertaining to data collection and processing, you are informed that the data collector is Blizzard Entertainment, Inc., and the data collected will be transferred to the United States of America. Upon request, you will be provided with access to your personal data. You also have a right of opposition to the data collection, under certain circumstances. To exercise such right, you may write to "2011 BlizzCon Costume Contest – Personal Data,” c/o Blizzard Entertainment, P.O. Box 18979, Irvine, CA 92612. You may also withdraw your personal data upon request, however you will be disqualified as a entrant in the Contest if you withdraw your personal data prior to the determination and fulfillment of the prizes listed in Section 4 herein.
General Release. By entering the Contest, you release Sponsor, participating sponsors and any of their respective parent companies, subsidiaries, affiliates, directors, officers, employees and agencies (collectively, the "Released Parties") from any liability whatsoever, and waive any and all causes of action, related to any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with the Contest or delivery, mis-delivery, acceptance, possession, use of or inability to use any prize (including, without limitation, claims, costs, injuries, losses and damages related to personal injuries, death, damage to or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light, whether intentional or unintentional), whether under a theory of contract, tort (including negligence), warranty or other theory.
Affidavit & Release: As a condition of being awarded any prize, winners will be required to execute and deliver to Sponsor a signed Affidavit of Eligibility, which includes an acceptance of these Official Rules and a release of liability.
Winners List; Rules Request: For a copy of the winners list, send a stamped, self-addressed, business-size envelope after November 30, 2011 and before May 31, 2012 to Sponsor at the following address: “BlizzCon 2011 Costume Contest -Winners List,” c/o Blizzard Entertainment, P.O. Box 18979, Irvine, CA 92612. To obtain a copy of these rules, send a stamped, self-addressed business-size envelope to Sponsor at the following address: “BlizzCon 2011 Costume Contest -Rules Request,” c/o Blizzard Entertainment, P.O. Box 18979, Irvine, CA 92612. Residents of WA and VT may omit return postage.

Miscellaneous: The Contest and these Official Rules will be governed, construed and interpreted under the laws of the United States. Sponsor reserves the right to change these Official Rules at any time, in its sole discretion, and to suspend or cancel the Contest or any entrant's participation in the Contest should viruses, bugs, unauthorized human intervention or other causes beyond Sponsor's control affect the administration, security or proper play of the Contest or Sponsor otherwise becomes (as determined in its sole discretion) incapable of running the Contest as planned. Entrants who violate these Official Rules, tamper with the operation of the Contest or engage in any conduct that is detrimental or unfair to Sponsor, the Contest or any other entrant (in each case as determined in Sponsor's sole discretion) are subject to disqualification from entry into the Contest. Sponsor reserves the right to lock out persons whose eligibility is in question or who have been disqualified or are otherwise ineligible to enter the Contest.
